Often when people go into business, they tend to think that their product and service names are unique, clever, and have never been thought of before. Business people tend to forget that there are millions of other creative people in society, and some may have come up with similar business ideas.
Before launching a brand or product, one factor to consider is, does anyone already have the same or similar mark? Under U.S. Trademark Law, if a name or logo that is the same or has been previously filed in the Applicant’s field of business and can be deemed “confusingly similar,” then the Applicant may be denied protection of the mark. To determine the answer, there are two main places to look: the U.S. Trademark Office Search Database and the Internet.
The U.S. Trademark database stores all the names, logos, and other identifying characteristics that have garnered federal trademark protection. The Internet should be consulted because not all companies register their company names and brand names with the U.S. Trademark Office.
